My girlfriends dads car was hit today whilst it was parked up. He has the guys details but he doesnt want to go through the insurance the guy has agreed to pay for the repairs. Should he still report it to his insurance company as precuation or will they say you have to claim.

The insurance company will say you have to report it to them. However, they may well up his premiums as he was involved in an accident even there was no blame & no claim.

As long as the other guy actually pays then no issues. I don't think he is contractually obliged to tell them, however there will be no comeback if the repairs are done badly.

Anyone know any better??? :D

I don't think so, they would advise it, but even if not he will then have to declare it for 3 to 5 years as being involved in an accident which could increase the premiums.

TBH if he does inform them then he may as well make a claim through them, or else he gets all the penalties with none of the benefits

you have the right to claim on you insurance. however you will need evident proof to show it was him who hit you, anyone can make up circumstances. you could ring your insurance company and ask advice about the incedent. and see what you can do legally if he changes his mind about paying. you are never forced to claim. nor update the status of your car. it is done on a good faith contract.

if you however were to claim at a later date, and there was already damage to the car. The insurance company would not pay for the previous damage. just the damage cause by the impact of the second incedent. if you dont trust the guy then go through insurance. but be prepared for the fact the other guy doesnt want to play along. it may be possible for your insurance company to claim back the repair costs from the guy directly, instead of his insurance company. but that would be through an approved bodyshop of the insurers choice. with 1st hand parts and a guaruntee. this would be my option. you would initially pay an excess and untill the guy admits reliability, you could lose no claims

(previously worked for hastings direct, in the total loss department. So i have a fair idea of what im talking about, but im not a genious on the subject, so please dont hate me if my information is incorrect) just make sure you every every intimate detail from the guy who smashed your motor up!

if the guy is reluctant to claim. it is more than likely his car is a previous total loss and he has not provided that information on his quote. if he was to claim, his car would be worth considerably less, and it is more than likely the insurance would scrap it. either that or it is on the road illegally. (cat B total loss or above)

He is not sure what to do he has the guys contact details and address and seems ok. As the guy was turning the corner his suspension came off and his car pulled to one side causing it to my his car. I think ill tell him to report it to his insurance just incase it bites him in the ass in the future.

in that case it will more than likely be an invalid claim on his part anyway. as the crash was caused by something incorrectly installed/damaged. unless the engneers find otherwise!
