Is the car worth more than you owe on finance? either way sell it quickly and pay them what you can, try to come to a lower settlement figure with them, otherwise they will sell for next to nothing and you will still owe them money. I was going to say that if they take it & sell it you may still owe them money depending on the terms of your contract. Be careful if you are thinking of selling them yourself before repossession....depending on how long the finance has been going, and the balance outstanding, the finance company will still own the 'goods', and chase for any shortfall...even from the new owners. Ask them about this and see what they say. They may give you an agreed period of time to sell them yourself. After all, you may get more private sale than they will at auction. Easy to say, but try to keep with it...its bad enough, but its not the end of the world. Hope your luck changes for the better soon, all the best lad. mkirby Posted March 19, 2009 Share Posted March 19, 2009 yeh surely its worth asking the finance company for a week or so to try to sell both items as they will understand that they will sell them on for peanuts and its a pain for them to have to sell them so its in your best interest to get their permission to flog them and get as much as you can for them as it will mean you will owe them less in the long run? Shane, if you want your membership renewed the offer is there with both of us? With regards to your car situation, if you can, sell the car and bike asap. Stick the money you get into an account for the finance company to take regular payments out from. This should give you a few months worth of payments to get yourself on your feet. You will get through it and things will get back to normal. As for membership here, you've been here over 3 years, can't you ask for a lifetime membership, then at least you can stay and have a laugh and get out to meets. 3LL Posted March 19, 2009 Share Posted March 19, 2009 I think as has been stated your would be better off selling the items for as much as you can get, even if its not there total value, it will be more than they will be worth at auction to an insurance company. You should also be able to let them take you to a court regarding the repayments and if you can pay a small ammount each week such as £1 and provide a means test of your financial situation they cant do shit all mate! In the eyes of the law and the judge, you would vewed as making the most contribution you are able to under your circumstances and you will be showing willingness to re pay any ammounts due. I would also advice gettin intouch with some debt advice charitys, citizens advice is a good place to start and from there they will be able to help you fill out a means test form to provide details of your income to the creditors. If you then send this recorded delivery to them, you will have evidence to support that they are fully aware of your financial situation, Cit' advice will also be able to put you intouch with other specialist debt advice agencies and charitable associations who will help you and also act on your behalf. You could also seek legal advice on the matter from a solicitor, there are loads out there that claim there expences from the courts and you dont even have to pay them a penny! In the eyes of the law, recovery of posessions is a last option and is only really considered if you litterally cannot afford to pay anything what so ever, even if only 5 or so quid a month it has to be a better option than giving the items back, especially if you then say to the magistrate and the debt collection agency that you also intend to privately sell the items relating to the finance as a means to provide capitol to go towards re paying the borrowed ammounts! Its a bit more difficult but it does happen. I have seen ads stating that a car has finance on it but the sale is to pay off the finance. A letter can be drafted and signed to state this is the case prior to sale. The car still owes the finance but if it comes to it the buyer then has some legal standing with the seller. Regarding my Supra, the problem being is when I did start my newest job which fell through earlier this week, I agreed to pay Close Motor Finance the cash oweing and the guy over the phone accepted my proposal...which obviously now isn't going to happen. I am already two months in arrears with the Supra and the third month coming up very quickly...personally I think Close Motor Finance will have no option but to end the agreement and take back the car as I can't pay a penny, im totally dried up I will have a word with the guy and ask him what my options are but I know what he is going to say... If anyone has anymore thoughs or ideas, please feel free to post as all the advice so far has helped me alot... The longer you wait, the worse the credit company will get their claws in. You're better off starting fresh with a clean account and saving for another one if that's what you want. Remember, n/as aren't that expensive these days and it's still a Supra! Try not to get all emo about the whole thing... a positive attitude is the most important thing for you right now.
