hogmaw
Question - will I get nicked if I use my phone in stationary traffic at a red light? In theory I think yes, but HOW can that be dangerous? Is it one of those blanket laws that has no discretion?
Guest Budz86
Yep. As long as you are on a public highway (ie; not pulled over) with the engine running you will get nicked. Even while in one of the M25's legendary traffic jams where no-one move's all week! Edit: not even sure the engine has to be running as my mate got 3 point's while on the phone waiting at a train crossing!

tbourner
Anyone got any wording for the offence? So we can pick it apart and find a loophole?
Ark
Yes you will. Only if you get caught. Edit: too slow.

PJ
I got a clip on bluetooth device that goes on my sunvisor. Cost £20 or so, not really a hardship when you consider everything and what you can face if you get caught. No brainer really.
tbourner
I always wear the leads when I'm expecting to be phoned (not often), otherwise it stays in my pocket. I don't think it's fair, however, to get points when on the phone at lights for example, so it'd be nice to know if there's something you can do - like if you switch off the engine and only re-start it when off the phone maybe. It's just a shame it doesn't fit all the other crimes where they have to PROVE you were doing it.
Scoboblio
I'm not sure of the wording around it (and far too lazy to look it up) but it's probably something like 'whilst in control of a vehicle'. So whether in traffic or not, you're in control of the car so shouldn't use a phone.
