It's a very sad case but I can't sign the petition because I don't agree with this :Jamie’s parents joined calls for the introduction of a mandatory minimum prison sentence for any driver who kills, regardless of the circumstances. But thats UK Justice for you, and thats all that can be said about it in this country really..........so on that point i agree with the morals of the petition....... But i also have to agree with Jake, that a mandatory sentence "regardless of circumstances" is wrong. That could open up a whole area of wrongful imprisonments.....................and its too wide a topic to be able to even start on. Michael PS.....Immigrant, no licence, and full of drink ............... i would have personally preferred to have seen him take a good hiding, but thats just me. Jake Posted March 22, 2005 Share Posted March 22, 2005 Apparently it was one of those cases where the guy had been drinking the night before and was in an accident at 11.50am the next day. He might not have even known he was over the limit. I know there's been a few times when I've had a hangover and wondered if I'd pass the breath test if pulled. What happens if a drunk driver is driving along ... causes a clean sober driver to swerve - which leads a death. Life isn't black & white .. & neither should the law be. Green Peace Posted March 22, 2005 Share Posted March 22, 2005 However the law is changed it isn't going to bring that poor lad back, and if strictor sentances are passed it will also lead to more 'hit and runs' in my view...I think in this isolated case Jaimie and his family and friends have been grossly let down by the CPS...and unfortunetley its not the first time and won't be the last... The fact he was an Illigal Immigrant means nothing its the fact that he was drunk and driving without a licence or insurance...The words 'Illigal Immigrant' are text bytes used by the national papers in a manipulated attempt to highlight 'the constant failings of a certain 'red' political party...not to save the lives of our children! This is therefore a special case and should of been dealt with accordingly...but i agree something needs changing of course....God bless him and his family! It's not even that. The fact he has no insurance has nothing to do with the manner he was driving. Very surprised that the fact he was over the limit and didn't have a license could not be used to prosecute him more forcibly, though. Alex Posted March 23, 2005 Share Posted March 23, 2005 Regardless of circumstances....so an idiot who walks out infront of you on a Dual Carriageway and gets collected by a car...cause he's commiting suicide should also make the driver suffer twice...a) horrific memories and b) a prison sentance. yeah that's fair...and just because it's rare doesn't mean it won't/can't happen...how many people stand on train tracks waiting for a train to hit them? Want to jail those train "drivers" too as they have about as much say/choice in the situation as my above example! Every case should be tried on it's merits and facts not you hit someone, go straight to jail. Yes this case is harsh...but it's not reason for a law like that...
