Someone crashed in to me!!!

ok so last night i was on my way to go and play football and was coming round the roundabout, which has and exit with two lanes, i was on the inside nearest the roundabout,i indicated and tried to take my exit when the person in the outside lane to my left tried to carry on going round the roundabout to the motorway exit!!! they smashed into the side of my girlfriends car that i was borrowing and then we both stopped, me expecting them to be apologetic when they started ranting at me saying that they were in the right lane to go the whole way round the roundabout!!! they then started slating me saying i was going to fast and that i was a boy racer and that i cant of had my llicence 5 minutes!! that pissed me off because im a careful driver and have been driving nearly 4 years without a crash.

 

I called the police to get them to come down and try and clear things up but they said they wouldnt come unless someone was injured! so its been left that its going through the insurance to be decided. there were two of them in the car so there goes my no claims as i was on my own and no witnesses stopped.

 

Im soooo angry about it as i was only 3rd party on my girlfriends car so im going to have to pay for her damage my remaining insurance and the excess and lose my no claims!

 

Ive taken photos of all the road markings and annotated them and im going to write a statement of events, ive also reported the incident to the police. does anyone have any ideas about what i can do to fight them blaming me?

Hmm, the police wouldn't come to the scene of an accident because noone is hurt? Something fishy there. If you said an ambulance wouldn't come then i could understand, i have heard of the police attending many crashes involving claims. One of the guys in my work was in a bump the other week on a roundabout, woman claimed it was his fault and he did the opposite. He called the police who came out and verified to the insurance companies that it was in fact her fault.

 

Guess you have been extremely unlucky or not been forward enough with the police.

well i spoke to them at the scene( the police that is) and i said i want someone to come and verify because there is a disagreement and they said they dont come to things like that and i was like no ive always been told to call the police if theres a dispute over fault and the women went into one saying under so and so section its states blah blah blah and i was like okkkkkkk.

 

So i called them later to make a statement so i can tell the insurance company a reference and they said again that they dont go to things like that? Im not one to bash the police but seriously is it to much to attend an accident these days? il post some of my pics up that ive drawn on later when i get a chance.

That's very unlucky, I hope you manage to get it sorted in your favour.

 

I almost had it happen yesterday, guy on the outside lane (to exit) chopped me up just as my lane filtered to the outside - then got head shaking and hand signals etc from the chap thinking he was in the right. :rolleyes: Even if you learn to drive in a muppets society you should know to follow the road markings.

aw, how crappy sorry to hear this. My dad had a similar incident last year, it went to court and the judge made them go 50/50 in the end

 

I can see that happening here too. Your post seems to suggest you were aware of his presence on your nearside and you indicated and moved across assuming he was going to exit the roundabout too, with you. Your assumption was incorrect.

The other driver on the other hand put himself into a dangerous situation through poor lane choice and position around the roundabout.

In my opinion, it was both parties at fault.

I had a incident a few years back where a little tear arse in a fiesta with all his mates smashed into my ex's Rover. Police said they wouldn't come out, but when I mentioned all his mates were in the car and I could smell alcohol.... ;) It suddenly became a different matter. They came down and breathalized him and he was clear (of which I had no doubt really), but at least they turned up and looked at the marks on the road etc! :D

 

Hope they sort it out mate!

Contrary to some of the above posts, the police will NOT atttend an accident unless someone is injured or you are blocking the carriage way.

 

Miles, I would get as much evidence as possible to show your road position. They should not have been in the outside lane on any roundabout if you are taking a later exit. The fact that there are two lanes coming off the roundabout will show that you were in the correct lane and would therefore assume that anyone to your left would be going in the same direction.

 

Take photos of the road and the damage to the car. I reckon if you argue well enough, you will get this one in your favour!!

He drove into you because he assumed what route you would take, even though you signaled. I was in a similar situation when someone drove into me after he took a fast line and cut me up, spun me out into some railings :rolleyes:

 

Police said same thing, no one injured so they wouldnt come out.

 

I was furious when he obviously suped up his 2 'witnesses' (no one stopped and he left before me) and my insurers wanted to go halves so I took the blighter to the small claims court to prove a point. I won :yu: but the judge when summing up said that the other driver shouldnt have assumed where I was going :rolleyes: I got my no claims back but it took 2 years.

 

It depends if you really feel you were right and can prove it. Any doubts, let it go and bite the bullet or they could take you to the cleaners depending on their barrister.

I think there is no set rule personally.

 

I have heard of instances where the police have come out where the caller is a woman and the people who have driven into the back of her is a group of young lads. Prevention of an assault/battery is a role the Police play is it not?

 

I was under the impression a roundabout leading to the motorway might be sufficient to result in the Police attending....

The witness has to be independent so his passengers statement will amount to nothing. However I do agree Rob. There is an element of you at fault. You knew he was there. You should've been in the outside left lane if you were going to leave the roundabout and the other guy should have been on the inside. You have to drive defensively and assume everybody is an idiot. You don't say whether he was indicating to continue round the roundabout. If he wasn't, say so on your statement. Sorry mate I think this is going to be one of those long drawn out ones.

thanks for all your comments guys, its good to see some opinions on it, i didnt see any indication from them to be honest but i didnt think that they would carry on round. the markings on the road show that they should have taken the previous exit on the roundabout and at worst surely they should have taken the exit that i was taking? i didnt think that you could go the whole way round a roundabout in the outside lane?

 

the only other option that i could think of was to see how much the damage on there car and if its not that much offer to pay for it even though im adament that it wasnt my fault. I think u should go into a tailors and get the buttons removed from your back ;)

 

Get photo's, do decent drawings of the roundabout and what took place, be completely and 100% adament that you are correct and get a 3rd party claims company on the case.

 

By the way, are you sure you lose your no claims bonus? I didn't know you could lose no claims with 3rd party insurance calims. I'm pretty sure u cannot protect it, hence why i assume you cannot lose it.

 

Find out as much information as you can but don't take the hit without knowing its your last option.

Even if it does go 50/50 in the end there will be a claim on my policy which would mean i would lose my no claims wouldn't it? i've annotated all my photos now, going to get a google map image aswell so they have an aerial view of the roundabout and write a statement up today to send to them once i have called them later, can i get a 3rd party involved to help me without having to pay, i mean that they would take there pay from the insurance or something?
