An appeal hearing in a magistrates court in Llanelli has resulted in the overturning of a noise abatement order that was imposed on the Welsh race circuit at Pembrey and has ordered the local Carmarthenshire Council pay the circuits costs in the case which total more than £60,000. The magistrates decided the circuit had not, as alleged, created a statutory nuisance and overturned the order imposed last September after receiving complaints from two nearby residents who said the noise from the races, and from testing events, was making their lives a misery. After the verdict, council representatives expressed their disappointment that residents would no longer be protected from unreasonable noise from the track, but Pembrey circuit director Phil Davies welcomed the verdict saying, "We are very pleased with the outcome of this appeal.Although we regret it had to go to court at all - we believe it could have been resolved without that." Speaking at the hearing, council lawyer Jonathan Rees alleged that the track caused an "unreasonable interference with the enjoyment of their properties," adding that, in the words of one of the complainants, the sound was like "a swarm of angry bees". The magistrates said, however, that there were several reasons why the order was not warranted, including that the race track has been operating for nearly 20 years, that in that time the track had stopped testing Formula 1 cars, that the number of complaints about it was exceptionally low and that noise readings were often much lower than the 50 decibel acceptable level set by the World Health Organisation.

I wonder if that bodes well for the other UK circuits - in that maybe they could overturn any noise limits!

 

Sanity comes in flashes, not torrents, I would bet that the Pembrey one goes to appeal in the end :( The circuit owners should have united years ago and fought this nonsense as soon as it reared its ugly head.

I just dont get it, the whole British Society are becoming a bunch of moaners, the whole fiasco is a waste of time and taxpayers cash, why is it even allowed to get to this stage?

 

I worked on a project up North and I remember a camp southern Englishman complaining that they were building a house within a mile from him and they were spoiling the tranquility - people were sympathising with this kn££!!!!:blink::blink::blink:

 

If he didnt want to be anywhere near civilisation then why did he make the 2mile walk to the local hotel bar everyother night!!

 

I can't see much racing going on at night in this instance, just a case of too much time on their hands, and probably support from their MP(with the same problem:rolleyes:) trying to gain an extra vote

It happens everywhere. Idiot splashes quarter of a million on a house without even checking the local area. Have a look on Googly Maps at how close the houses are to McClaren/Clearways at Brands Hatch. Those are big properties, maybe over a £million. Then they complain about the noise because the estate agent told them it was quiet "now the Grand Prix's gone to Silverstone".

 

Same thing is happening at Croft, up the road a few miles from me. Theres a moderate estate built in the 80s-90s about a mile away, and they're always complaining. You can't drive into the estate without passing several of those brown roadsigns that say "Croft Circuit - motor racing." Idiots, everywhere.

Exactly. I wonder if the 2 residents who complained have lived in their homes for longer than the track has been in existence (20+ years) and had similar levels of usage?

 

If you don't like the noise from a track, don't buy a house near a track!!

 

After the hideously expensive terminal 4 planning process, I thought the government were changing some of the regulations about such things, or perhaps that's specifically for public inquiries and not local noise abatement etc.

They are, its more to do with getting things through planning by way of central govt rather than local authority, to stop Nimbyism.

So if Heathrow needs a 6th terminal, it goes through as its a nationwide issue, not just Hounslow.

i live near there. been there a few times and obviously it can get a bit noisy but the houses down that way a few and far between and none iirc right next to the circuit. theres also an airport near by there aswell, wonder when theyl start complaining about the noise there aswell

more noise is made in stradey park on a saturday than pembrey race circuit and there are a million and one houses surrounding that place and ive never heard of anyone complaining about that:)
