send a virus to someones email address?? Im getting bloody sick of these nigerian scammers and im thinking of ways to destroy their empire, replying to them with a virus to destroy their comp could be an idea, but would i get locked up?

 

no you wont get locked up

as an insurence policy just re-route a proxy ip address

i have a few choice scripts, one of which i wrote myself

if you want to do it and get away with it just send me a PM

i'll hook ya up

I almost got caught out sending my psp in a similar scam!

In 2004 the All Party Internet Group published its review of the law and highlighted areas for development. Their recommendations led to the drafting of the Computer Misuse Act 1990 (Amendment) Bill. which sought to amend the CMA to comply with the European Convention on Cyber Crime. Under its terms, the maximum sentence of imprisonment for breaching the act changed from six months to two years. It also sought to explicitly criminalise denial-of-service attacks and other crimes facilitated by denial-of-service. The Bill did not receive Royal Assent because Parliament was prorogued.

 

Also i'm almost positive this law only applys to UK & Irish citizens... last i checked i'm a United States citizen so ha!

And therefore you will get prosecuted under federal telecommunications law, and the penalities are just as high.

(B) a fine under this title or imprisonment for not more than 5 years, or both, in the case of an offense under subsection (a)(2), if--

 

(i) the offense was committed for purposes of commercial advantage or private financial gain;

 

(ii) the offense was committed in furtherance of any criminal or tortious act in violation of the Constitution or laws of the United States or of any State; or

 

(iii) the value of the information obtained exceeds $5,000;

Something to bear in mind, if the US has relations with your home country they are capable of prosecuting you under federal law if your communications crossing american soil at anytime....

Just send it no one is going to do anything.. If they do just claim you didn't even realise and it must have been that virus on your machine that sends out emails to everyone on your inbox..

 

Your all to worried about being caught.. I really dont think some nigerian scammer is going to have much of a leg to stand on.

No, but if he sends it from say a computer that perhaps he didn't have full access to and it happens to be on a company network.... then well the law would certainly ask you to pucker up....

 

Most spam emails are sent via BotNet's and not the originator's PC.

The whole question of whether it is illegal or not is slightly pointless to me. I doubt the naughty Nigerian is going to report the incident to the Police since it would be like hanging himself.

 

I doubt the ISP would care since to prosecute you they would need to prove you intended to do it...

If you have to ask the question you certainly don't have the know-how to "destroy their empire with a virus to destroy their comp"
