Leaks in flats - who's responsibility?

Hi there guys,

 

Just wanted some advice as a landlord...

 

It seems the waste pipe from the dishwasher in my flat fell out and was leaking through the floor boards. I've now fixed the waste pipe, but my tenants got a letter through the door from the tenants below who have noticed a wet patch on their ceiling.

 

My question is who does the responsibility lie with to fix any water damage? The service charge for the block includes building insurance and I have my own contents insurance which covers such things within my flat...

My last flat got flooded by an idiot in the penthouse going out with the washing machine on, flooded six flats, his contents insurance wouldn't cover the damage as it went into 10's of thousands of pounds. Ended up having to claim on our buidlings insurance. This was after they'd flooded the flat below them 3 times:blink:

 

Got a new kitchen and whole flat redorated but was a nightmare, industrial dyers for weeks to dry it all out.

 

Sorry to say it will come out of your insurance:(, make sure you put a clause in in future to say they must not go out with either dishwasher or washing machine on, you don't want to be on the receiving end of complaints like the landlord of that flat did;) At least if they're in the damage can be limited, like I imagine has this time.
