bmx1lew Posted April 12, 2008 Share Posted April 12, 2008 Today I got a letter for jury service, however it is dated 9th June but I am on holiday for the 1st until 15th of June, can I be excused ? You can ask to postpone your jury service if you have an important family event, such as a holiday that is already booked and paid for. A long standing hospital appointment, recovery from an operation or a family wedding may also be reasons to ask for a postponement. Postponing for these reasons is known as deferral of jury service. Your holiday may prevent you from serving on a jury at the time that you are summoned but won't prevent you from serving at another date. If your service is deferred you will be asked to confirm any other dates in the year when you won't be able to attend, so that you are given a new date that is convenient. Jury service can only be deferred once. You apply to have your jury service deferred by completing the section in the summons form called 'Deferral and Excusal'. When this has been accepted you will get a letter confirming the deferral and giving you a new date for your jury service. You cannot defer twice and must attend on this second occasion. Unfortunately I was living in Southampton (just still on the electoral register at my parents place). Guest Artermis Posted April 12, 2008 Share Posted April 12, 2008 you maybe able to get excused from jury service, you should have some forms to fill in, question 3 is the one you want i think. you can apply for a discretionary excusal in part C, though you are more likely to get away with a deferal under part A i would think. its a civil duty which you are expected to perform unless you have very good reasons for not doing so. as you are technically fit and able to perform your duty, then a deferal is more likely as you are unavailable on the requested dates. more details should have available on the courts website Link to comment Share on other sites More sharing options...
JamesG Posted April 12, 2008 Share Posted April 12, 2008 I got summonsed for jury service a couple of months ago. Work asked me to request a deferral as we are very busy at the moment. The deferral was successful and I got another date through (July, I think). I'm actually looking forward to it. Think about it, two weeks off work, almost certainly fully paid (mine is, and most companies will top up your payments up to your salary). And it's bound to be pretty interesting, as it's the more serious cases that need a jury. Edited to say, I would guess that a pre-booked holiday is sufficient reason for a deferral. I have court on the 21st May as a witness but I was supposed to be away on holiday, I ended up just cancelling though as I really don't want the beatch getting away with it. Angarak Posted April 12, 2008 Share Posted April 12, 2008 I was summoned for Jury service, I deferred it and was summoned again 12 months later. The 2nd time I was busy again (self employed) so was excused from it. They where reasonable with regards to my circumstances from my experience - though dont leave it to the last minute to defer.
