Aaaaarrrggggghhhhh!!!!!!

About a week ago when i was driven to work some old lady went up the ass of me, Anyways i was nice and carm because it was my 306 td so was not that botherd. I made sure she was alright and looked at the damage. Was not major she just cracked my bumper. Anywas i said would you like to do it through insurance or sort it between us. She said insurance. I was worried though since the car was a N reg and not worth much it would be written off. Anyways i got a call the next day saying she wanted to do cash, so i said for a new bumper and sprayed it will cost £480 but just give me £400 cash which she was fine with.I thought i will not replace it and be quids up GREAT...Anyways i week has gone and no chq. So i called her up and she said her son wanted to have a word. Saying he cant beleive it costs that much bla bla bla.He was saying all the bumpers are the same and cost about £150(Like i said i had the sports one with the xsi bumpers and it was £340.I was SOOOO ANGRY. Now she wants to go through insurance. I now have the risk of the car being a write off. So now the bill to them is going to be £500 if it gets carried out. I really hope it kills her on the insurance. OH he also said because she had a flash car i might of thought she had loads of money and was trying to rip her off.It was a new mini, Oh yea there loads of Fuc**ng money YOU TW*T) As you can see im not in the best of moods....Its a nice clean 306 td with sports bumpers as well :(. I will have to try and buy it back of them.

if it was not your fault then they cannot write it off it is in your rights that it gets put back the way it was.

 

Yip. Happened with one of the guys in my work. I wasn't sure if they couldn't write it off but i know its a damn site harder if your adament :D

But if the repair is more then book value the car will be written off

 

They will not repair a car if the repairs cost say £1000 but the car value is £500

 

the cost of the car being repared is going to be about £500

I think Datson is saying that if the car is damaged and it is someone else who did it, their insurance can't write it off, they have to fix it. If you claimed through your insurance though, they could write it off.

yes i agree only your insurance company can write off your car, as it's someone elses fault you can insist on it being fixed instead.

 

As a general note when your insurance company decides about whether a car is written off, if the repairs total half the value of the car it's declared a write off.

sorry not true,my mondeo was written off, a jag crashed into the back when i was stationary.it was classed as cat c if the repair

cost is more than a precentage of the cars value its written off.Also if it is a write off you wont get a courtacy car .IF it goes for repair you will.

you should be ok if its just the bumper

well there is one thing i can do is that i will get money if its written off then i can buy the car back for £50

 

IF they write it off start looking at car prices so you have an idea of the market value of your car.don't take the first offer, for

some reason its always low.

I've heard this too. Get what the car is worth. Hopefully it won't come to it anyway.

 

Quite often insurance comapanys only go to 50% of the car value in repairs (well so I've heard). If the car is worth £1000 and the repair is £500 you should get away with it. :tongue:

Its just a load of hasstle that you dnt need , Its must of been really hard to spot a bloody bright red car bang in front of you....IN TRAFFIC!

That's the $64,000 question. I thought only your own insurer could force you to write off your car, but I have very little expereince of this.

 

I did have a previous car that someone else ran into the back of (similar to this thread). The car was on its last legs anyway, so I let the insurers write the car off and give me the money. If I had wanted to keep the car on the road, perhaps I could have insisted that it be repaired no matter what the value/cost ratio was.

It is true. The only person that can write off your car is your insurer. If someone else is picking up the tab, ie the other persons insurance, then they must repair the car while it is safe to do so. If there is any structural damage that would jeopardise the safety of the car then it will be written off but if it can be repaired, it will.

 

Same goes for modified cars. If someone bumps into you the insurance company must repair the car to the standard it was at before the incident regardless of value or cost.

 

Example...

 

Glass evaluation £200 fiesta with £1000's spent on it. Cracked bumper costing £200 not including paint. If its your fault the car will be written off, if its not your fault the other insurance company MUST repair it.

 

The other insurance can push to have you write off your car but only with your consent. If it were me they would have to make a VERY good offer for me to be willing to do this.
