If they just said as of tomorrow, driving whilst having your mobile turned on gets you 4 years, no arguments, I bet they wouldn't find anyone driving with their phone turned on again. As things are, people are going to carry on doing it, because they don't even think about the fact it might lead to somebody's death - it'll just be the unlucky one who the cyclist rides out in front of that gets the sentence..... This paragraph can be understood a number of ways: Are we sure the "text driver" didn't jump the red light (i.e. not the cyclist)? The report also implies she was travelling at 45mph in a 30mph limit. Many cyclists annoy me on the road, especially ones that do jump red lights and don't wear helmets, but if the car driver was texting, did jump a red whilst speeding and subsequently killed the cyclist, then 4 years is nowhere near enough IMO. Sorry Alex but that isnt right, we all have a duty of care on the road,were all meant to be aware of such things like cyclists in front of us, fair enough "if" the cyclist did go thru on a red he or she was wrong- but one has to ask,if the car driver was doing 30mph would the cyclist still of died ? He went through a red, end of, all bets should be off...he shouldn't have been there to lose his life. Same with burglars who get shot in farm houses...shouldn't have been there. My cousin was killed by a guy driving in a bus lane in a car with no tax and no mot, speeding and he left the scene of the crime. He got 4 years. Now which is worse?
