jonshaw_uk Posted January 12, 2005 Share Posted January 12, 2005 hi all looking for some advice please, i sold a set of subs on ebay back in december - the subs (AW1200Q Audiobahn) were brand new and had never been used and still in the original boxes. The winning bidder had them for 2 weeks and then emailed me to say that her son had taken them to be fitted and the fitter had told her that the suspension in the one sub was faulty. I told her that i didn't provide any warranty on the items as it didnt state that they came with a warranty. I wasn;t trying to rip anyone off as i have sold loads of these subs and never had a problem. I told her that her son or the fitter may have damaged them and i wouldnt exchange them. terribleturner Posted January 12, 2005 Share Posted January 12, 2005 If your not a trader like Tom said then there's pretty much nothing Trading Standards can do as far as i'm aware. Either trying to get a refund saying stuff is damaged, or didnt turn up, so i send everything recorded delivery. At the end of the day there will always be one........... I have 198 positive feedbacks and two negatives, kind of says it all. All she can do is leave u negative feedback, but do u really care? Let her do it and do it to her in return stating your case.....and put it down to a bad experience. If she had came to me and genuinely said that her son had broke the sub then i would have sold her another at cost price. But when she came shouting the odds saying the company that were fitting it told me that the suspension is damaged and i need to replace it no questions asked and more or less straight away i got slightly wound up. This is the second time this has happened and the first time i took it as the items were faulty and got them replaced. i thought this is weird cos all the items are checked before being sent to me then i just send them via couried. I sold a few bits to someone who rang me up a week later to say that it doesnt work - i took it back returned it and the new one worked. Then a week later the other item was faulty so i that back and replaced it and the new worked. Once i returned the items back to the supplier he said i was the first person in about 2 years to have any faulty equipment as its all checked first before being sent out. When checked the items had been incorrectly fitted resulting in damage - but i managed to get them replaced under warranty but i had to pay another £70 so it cost me money in the end. i was not impressed Quote Link to comment Share on other sites More sharing options...

I doubt she will contact trading standards, she probably just wants your address so she can 'send someone over!'. Ask for the name and number of the person she has been speaking to at Trading Standards and tell her you will phone them. Also if you choose not to ignore her, ask her how she can contact trading standards when your not a goods trader lol. Your not governed by the 1974 Sale of Goods Act, and the most she can do is complain to Ebay.
