any architects, builders or law type people here this morning?

im in dire need for help!

 

im currently doing an assignment on construction contract law mainly looking at delays,loss and expenses, extension of time and such and really struggling to find any usefull info on the net. one other thing aswell is JCT 98 a traditional building contract? im guessing it is but my brain is well and truly scrambled this morning:blink:

I think you can read draft copies of all JCT contracts on their website

JCT98 is a standard form of contract ie traditional, although it has many addenda where you can incorporate contractor-design elements (eg. the roof, I might draw it and say I want wriggly tin in x colour, but there's no way I'm taking responsibility if the wind blows it off 'cos the screws ain't man enough). It is essentially though, a contract between client and builder, administered by the clients architect.

 

D&B is a separate contract. There are mant different levels of D&B though, an architect might draw up a whole scheme and it could still be procured as D&B, the other end of the scale is that a client may just asked for a B&Q type shed for 3000sq.m of retail space and leave it up to the contractor to get an architect to design the whole thing.

thanks rob. this assignment was meant to be an exam on teusday but after everyone wrote a letter of complaint about it being to complex for an exam they changed it to an assignment. thank god i say as i would have been royally fooked otherwise!

Oh, remember that Liquidated Ascertained Damages (LADS) must be a true reflection of costs incurred by delay, and must not be a "fine" for each day a job runs over.

 

eg, a new-build hotel could set LAD costs at the loss of earnings per day for every day they are not open due to a delay, whereas say if a new school extension were being built and ran over, it wouldn't really cost the school anything as they would just carry on using the same accommodation as always. Important bit to remember that.
