Plus if that happens then it's as good as them admiting liability! I think thats only available if you have agreed liability with the other side first. I would've thought that with his injuries that he would be able to claim something through that policy. Hope things get sorted out for you soon, sounds like an awful situation for you to be in. Mind you there's usually a get out clause for them anyway...Such as if your accident happens on a day ending in y then you're not covered!! I'm in Engineering and belong to a union, they are pretty useless for most things these days but in cases like this they come into their own.
