Only just read this. Seems blackies mate did the right thing in the end, but wtf are people pointing the finger at blackie for the posting.

 

Christ man, anyone of you giving him a hard time sit back and go over your lives and then hold your hands up if you have never ever done something morally wrong.

Exactly. i know i've done a few things i regret in the heat of the moment. but i rectified them as soon as i realised. we're only human ;)

Well I'm glad Blackies friend did the right thing and took it back.

 

Theft is theft, doesn't matter about the moral aspect of it, and at the time it was taken the offence of theft was complete, regardless of the fact that the person had a change of heart afterwards.

 

Blackie, you did a good thing convincing your friend to do the right thing.

Technically theft is defined as the act of taking an item from someone with the intention of permanently depriving them of it - it could be said it was a judgement error on his part and the fact that he eventually took it back means that the 'theft' charge probably wouldn't stand up, or at least could quite easily be contested in court.

 

It was taking without consent though, clearly.

Intention to permanently deprive is open to interpretation and even borrowing someone's tools with the intention of returning them at a later date has been construed to be permanently deprive.

 

His friend also breached s2 of the Fraud Act 2006 (Fraud by False Representation) by stating that the bag was his.

Mens rea and actus reus spring to mind.;) Ie intention at the time. The fact that he changed his mind is not a defence.

 

And the correct definition of theft is ;

 

A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it. Section 1 Theft Act 1968.

My mate has wanted a nintendo ds since his misses got one a christmas. he was down the bank earlyer today and got talking to a woman he knows, she askes if a football boot bag on the table was his, he said yes and picked it up. in there was a brand new ds with charger, two top end games and an extra stylas. as i said he wanted one for ages, what would you do? half of him knows its some kids but half of him thinks he shouldent of left it lying round

 

He took it. He should not hand it back. He made a desicion and should live by it.

I have got a son, two infact! it pi$$es me off that nearly everyone that has posted in this thread thinks it was me! Have i totally miss represented myself some where over the past few months? when the f**k have i ever said/shown/implied i am even slightly dodgey? The bloke was here with me at time of posting and you deffinatly pushed him in to taking it back, which is good, but it seems i havent got as many "mates" on here that i thought

Although I wouldn't want you round my house as we have a DS, Playstation and often leave cash lying about!!
