Theft is theft, doesn't matter about the moral aspect of it, and at the time it was taken the offence of theft was complete, regardless of the fact that the person had a change of heart afterwards. Technically theft is defined as the act of taking an item from someone with the intention of permanently depriving them of it - it could be said it was a judgement error on his part and the fact that he eventually took it back means that the 'theft' charge probably wouldn't stand up, or at least could quite easily be contested in court. Intention to permanently deprive is open to interpretation and even borrowing someone's tools with the intention of returning them at a later date has been construed to be permanently deprive. And the correct definition of theft is ; A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it.
